These Terms of Service (“Terms”) govern your use of Mila Baby Tracker (“Mila,” “we,” “us,” or “our”) and Mila’s related local care, shared-care, sync, export, support, and monitoring services. Please read these Terms and the Privacy Policy before continuing to use Mila.
1. Agreement and eligibility
By affirmatively accepting these Terms, you enter into an agreement with Mila. You confirm that you are legally able to enter into this agreement and are at least the age of majority where you live. Mila is designed for parents and caregivers, not for direct use by children.
If you do not agree, do not continue using Mila. Declining does not itself delete care records already stored on your device or close an existing account. You may contact support about access, export, or deletion options.
2. Parent-operated care tool
Mila helps parents and caregivers record and coordinate baby care. You are responsible for the care decisions you make and for checking that entries, reminders, summaries, exports, and shared information are accurate and appropriate for your family.
Mila is not a medical device, medical provider, emergency service, or safety-monitoring service. It does not diagnose, treat, prevent, or monitor any disease or medical condition and does not replace adult supervision or professional medical advice. Contact a qualified clinician or emergency services when appropriate.
3. Shared care and authority
Shared care lets authorized people view or update a family care record. You may add child information only when you have the legal authority or valid permission to do so. You are responsible for choosing whom to invite, assigning appropriate access, protecting invitation links, and removing people or devices that should no longer have access.
People in a shared family may see and act on information according to their role. Before entering information about another adult or child, make sure you are allowed to provide and share it.
4. Accounts and security
You are responsible for access to your Apple account, devices, Mila sessions, invited caregivers, and any exports you create. Keep devices and accounts secure, promptly revoke lost or untrusted devices, and tell Mila support if you believe an account or shared care record has been accessed without authorization.
You must provide accurate information and must not impersonate another person, bypass access controls, misuse invitation links, or attempt to access another family’s data.
5. Your content
You retain your rights in the child profiles, care records, notes, photos, exports, and other content you provide. You grant Mila a limited permission to host, process, transmit, back up, and display that content only as reasonably needed to operate, secure, support, and improve the services as described in these Terms and the Privacy Policy.
You are responsible for the content you enter and share and must not upload unlawful content or content that infringes another person’s rights.
6. Acceptable use
You may not use Mila to harm another person; violate law; interfere with the service; probe, scrape, reverse engineer, or circumvent security except where applicable law expressly permits it; distribute malware; overload infrastructure; or use the service for unauthorized surveillance, advertising, data brokerage, or commercial exploitation of family or child data.
7. Privacy and device permissions
The Privacy Policy explains how Mila processes information and the choices available to you. Enabling shared care requires consent to the account, family, and care-record processing needed to operate that service. Camera, microphone, notifications, local network, monitoring, exports, and external sharing are separate optional features or device permissions where applicable. Accepting these Terms does not itself grant an iOS system permission.
8. Optional model research program
Mila may offer an optional research program that lets you contribute pseudonymized structured care records to evaluate and improve Mila’s care-timing features, as described in the Privacy Policy. Participation is voluntary, off by default, and never a condition of using Mila or any of its features.
If you join, you grant Mila permission to use the contributed pseudonymized records for research, evaluation, calibration, and training of Mila’s models and features, including models used to make predictions for other families. You may withdraw in the app at any time; withdrawal stops future contribution and stored contributed records are handled as described in the Privacy Policy, but models already trained are not reversed. Only contribute records you have the legal authority or valid permission to share, consistent with section 3.
9. Service availability and changes
We work to keep Mila reliable, but the service may be interrupted, delayed, changed, or discontinued. Do not rely on Mila as the only copy of important information or for emergency, medical, or safety-critical purposes. Features may differ by app version, device, location, family role, or service availability.
10. Ending use and deletion
You may stop using Mila at any time. Available in-app controls may let you delete local data, shared data, a family, or account-related data depending on your role and app version. You may also contact support for an account or privacy request. Deletion is subject to the technical, legal, security, backup, and retention limits described in the Privacy Policy.
We may suspend or end access when reasonably necessary to protect users or the service, comply with law, address security or abuse, or respond to a material breach of these Terms.
11. App license and third-party services
Mila and its software, design, and service content are protected by intellectual-property laws. Your license to the iOS app is also subject to Apple’s Standard Licensed Application End User License Agreement unless a custom license agreement is presented through the App Store.
Apple and other services you choose to use have their own terms and privacy practices. Mila is not responsible for third-party services outside our control.
12. Disclaimers
To the maximum extent permitted by applicable law, Mila is provided “as is” and “as available,” without warranties that the service will always be uninterrupted, error-free, complete, or suitable for a particular purpose. Nothing in these Terms excludes warranties, guarantees, or other rights that cannot lawfully be excluded.
13. Limitation of liability
To the maximum extent permitted by applicable law, Mila will not be liable for indirect, incidental, special, consequential, or punitive losses, or for losses caused by reliance on reminders, recommendations, monitoring, or user-entered information. This section does not limit liability that cannot lawfully be limited, including rights that may apply under consumer-protection law.
14. Governing law
These Terms are governed by the laws of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-law rules. Courts located in Ontario will have jurisdiction, except where mandatory consumer or local law gives you the right to bring a claim elsewhere or requires another law to apply.
15. Changes to these Terms
We may update these Terms. We will update the effective date and provide notice or request renewed acceptance when required or appropriate for a material change. Mila records the version accepted on the device and, for an account-backed service, with the authenticated account and device.
