Revision 5.0 · Acceptance generation 5
Terms of Service
Effective date: September 16, 2026
Contracting party: Rinat Akhmetov, an individual located in Ontario, Canada
Service name: Mila Baby Tracker is the name of the app and service, not a registered business.
Contact method: Email only at support@withmila.app
1. Agreement, eligibility, and language
These Terms of Service (“Terms”) govern your use of Mila Baby Tracker (“Mila,” “we,” “us,” or “our”), including local care tracking, account-backed Family care, reminders, exports, support, and monitoring features that are actually available in your app version.
By selecting a Mila action presented with the legal disclosure that says you agree to these Terms, you enter into this agreement. You confirm that you are an adult with legal capacity to agree and that you have authority to provide the child and family information you enter or share. Mila is operated by adults and does not offer accounts to children.
The French version is made available before a Québec user chooses another language. The English, Canadian-French, and Russian versions are intended to communicate the same agreement. Nothing in a language choice removes mandatory rights, including rights that apply in Québec. The Russian version is provided for convenience and does not reduce protections that cannot lawfully be limited.
2. Mila and care modes
Mila helps parents and caregivers record and coordinate baby care. You may use a local care profile stored on one iPhone, create an account-backed private Family using Sign in with Apple, or join a Family through an invitation. Available features can vary by device, role, location, app version, and service availability.
A person who creates a new Family is assigned the Owner role automatically. Mila does not ask that person to select Owner during onboarding. An invited caregiver receives the role assigned through the invitation and may have fewer permissions.
3. Child data and caregiver authority
You may enter information about a child only when you are the parent, guardian, or another adult with valid authority or permission to do so. You are responsible for keeping that information accurate and for resolving disagreements among adults who share care. Contact support if access or authority is disputed; Mila may restrict access while reviewing a credible safety, legal, or privacy concern.
4. Accounts, Apple identity, and security
Account-backed care uses Sign in with Apple. You are responsible for keeping your Apple account, devices, Mila sessions, invitation links, and exported files secure. Tell Mila promptly if you believe an account, device, invitation, or Family record has been accessed without authorization.
Signing out does not delete your account or Family. Signing in again does not require acceptance of the same legal generation again. Mila asks for a new acceptance only when a later material generation applies.
5. Family and Shared Care
Family lets authorized caregivers view or update a shared care record according to their role. The person creating or sending an invitation is responsible for choosing trusted recipients. Invitation links and QR codes must be protected like private access credentials.
Removing a member ends future access through Mila, but information already viewed, exported, or stored on an offline device cannot always be recalled immediately. The Shared Care section of the Privacy Policy explains recipients, roles, withdrawals, and account-versus-Family deletion.
6. Your content and Mila’s limited permission
You retain your rights in the content you provide. You grant Mila a limited, non-exclusive permission to host, process, transmit, back up and display that content as reasonably necessary to provide, personalise, improve, secure, maintain and support our products and to fulfil legal obligations, in accordance with these Terms and the Privacy Policy. Creation and use of anonymous information are governed by the Privacy Policy and applicable law.
7. Acceptable use
Do not use Mila to harm another person, impersonate someone, enter data without authority, misuse invitations, bypass access controls, distribute malware, disrupt the service, conduct unauthorized surveillance, or sell, broker, advertise against, or commercially exploit child or Family data. You may not reverse engineer or probe the service except where applicable law expressly permits it.
8. Not medical or emergency care
Mila is a logging and coordination tool. It is not a medical device, health-care provider, diagnosis or treatment service, emergency service, or safety-monitoring service. It does not replace attentive adult supervision or professional medical advice. Check entries, reminders, summaries, and monitor status yourself, and contact a qualified clinician or emergency service when appropriate.
9. Permissions and third-party services
Apple controls Sign in with Apple, notifications, camera, microphone, local-network, photo, and other system permissions. Accepting these Terms does not grant any system permission. Apple and other services you deliberately use have their own terms and privacy practices.
10. Service availability and changes
Mila may be interrupted, delayed, corrected, or changed. Do not rely on Mila as the only copy of important information or for a safety-critical purpose. We may change or discontinue a feature when reasonably necessary for security, law, reliability, or product operation.
11. Ending use, suspension, and account deletion
You may stop using Mila at any time. If you created an account, the app provides a way to initiate account deletion. A member or one of several Owners can delete their own account and leave a Family while the shared Family record remains. If the deleting person is the sole Owner, Mila will explain that deleting the account also deletes the Family record before the action is confirmed.
We may suspend or end access when reasonably necessary to protect users or the service, comply with law, address abuse, or respond to a material breach. You may request export or deletion without first accepting a new generation of Terms. The Privacy Policy describes retention limits and records that may lawfully remain.
12. App license and Apple terms
We give you a limited, personal, revocable, non-transferable licence to use Mila for its intended purpose. The iOS app is also subject to Apple’s Standard Licensed Application End User License Agreement. Mila does not use a separate custom App Store EULA for this release.
13. Warranties
To the extent permitted by law, Mila is provided “as is” and “as available.” We do not promise that every feature will always be uninterrupted, error-free, complete, or suitable for a particular purpose. This section does not exclude warranties or consumer rights that cannot lawfully be excluded.
14. Limitation of liability
To the extent permitted by law, Mila is not liable for indirect, incidental, special, consequential, or punitive losses caused by use of or inability to use the service. This limitation does not apply where law forbids it, and it does not exclude liability for bodily or moral injury or for intentional or gross fault where Québec or other applicable law protects those claims.
15. Governing law and mandatory consumer rights
These Terms are governed by Ontario law and the federal laws of Canada applicable there, without removing mandatory rights under the law where you live. A Québec consumer keeps the jurisdiction, language, remedies, and other protections that cannot be waived. These Terms do not require arbitration and do not waive class-action or court rights.
16. Changes and acceptance generations
We may update these Terms. For a material change, Mila will identify a new acceptance generation, provide the new documents and effective date, and request a new acceptance when required. A non-material editorial correction receives a new immutable revision within the same generation and does not by itself trigger another acceptance.
17. Additional features
Additional features may be subject to terms presented when they are offered. The Privacy Policy governs the collection, use and disclosure of information through our products, including product improvement and anonymous information.
18. Contact
Questions about these Terms can be sent to support@withmila.app or through the English support page. Do not send passwords, invitation codes, full care exports, sensitive baby notes, or monitor media unless support specifically and securely asks for them.
